We understand what you are going through and want to help. Bankruptcy can help you get your finances under control and your life back on track.  Most business and individuals will file either a chapter 7, a Chapter 11, or Chapter 13 bankruptcy.  Chapter 7 governs the process of a liquidation bankruptcy,  Chapter 11 permits reorganization and is available to every business, whether organized as a corporation or sole proprietorship, and to individuals, although it is most prominently used by corporate entities. In contrast,Chapter 13 provides a reorganization process for the majority of private individuals.

If you are struggling to pay your credit cards bills, medical bills, and other unsecured debts Chapter 7 bankruptcy may be an option for you. Chapter 7 bankruptcy is designed to discharge certain debts and give you a fresh start. A Chapter 7 bankruptcy case does not involve the filing of a plan of repayment as in Chapter 13. In order to file for Chapter 7 bankruptcy you will have to pass a Chapter 7 means test. Many people falsely believe they will not “pass” the test and will have to file for Chapter 13 bankruptcy, however, most individuals qualify for Chapter 7.

Chapter 13

One of the benefits of a Chapter 13 bankruptcy is that in many cases filing can stop a foreclosure or repossession and let you reorganize your debts. If you are behind in your home mortgage, car payments or other secured debts Chapter 13 may be the best option for you. Under a Chapter 13 bankruptcy your debts are reorganized and you will make payments to the bankruptcy court for a period of 3 years or 5 years. After completion of your plan most unpaid debt will be discharged.
